1) Agreement to terms

These Terms & Conditions (“Terms”) govern your access to and use of our website and the purchase of products from My Little Rascals Children’s Boutique (“we,” “us,” “our”). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

You represent you are at least 18 years old (or the age of majority in your state) or using the site under a parent/guardian’s supervision.

2) Products, orders & acceptance

  • Product info: We try to display colors, sizing, and details accurately; actual appearance can vary by device and manufacturer.
  • Order acceptance: Your order is an offer to buy. We may accept or decline any order, or limit quantities, even after you receive an order confirmation. If we cancel, we’ll refund you.
  • Availability: Inventory is not guaranteed until we ship. We may discontinue or change products at any time.

3) Pricing, promotions & errors

  • Prices: Subject to change without notice.
  • Errors: If we discover a pricing or description error, we may cancel or correct the order and offer you the option to proceed at the correct price.
  • Promotions & coupons: Non-transferable; one per order unless stated; may have category/date limits; cannot be applied to prior purchases; we may modify or end promotions anytime.
  • Gift cards & store credit: Treated as cash equivalents within our store; non-redeemable for cash except where required by law; we are not responsible for lost or stolen codes once delivered.

4) Shipping, risk of loss & taxes

  • Shipping estimates: Delivery dates are estimates and not guarantees; carriers may experience delays.
  • Risk of loss: Passes to you upon carrier’s delivery scan to your address or designated pickup location.
  • Address accuracy: You are responsible for providing a deliverable address; carrier-returned packages may incur reship fees.
  • Taxes & duties: You are responsible for applicable taxes/fees. We collect tax where required by law.

5) Returns & Special Orders

  • Standard returns: Most items are eligible for return within 30 days of delivery in new, unused condition with original tags/packaging.
  • Special Order items: Items that are made-to-order, custom-sized, personalized/monogrammed, or specifically ordered in for you are final sale and not returnable or exchangeable.
  • Labels/fees: If you request our prepaid label and choose a refund, a flat $8.95 is deducted (waived if you choose store credit for domestic returns).
  • Damaged/incorrect: Report within 7 days of delivery with photos; we’ll arrange a replacement, exchange, or refund after verification.

6) Accounts, reviews & your content

  • Accounts: Keep your login secure; you’re responsible for activity under your account.
  • Reviews & content: By submitting reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content for store operations and marketing. We may moderate or remove content that violates these Terms.
  • Prohibited content: No illegal, infringing, deceptive, hateful, or harassing material; no personal data of others without consent; no malware or spam.

7) Intellectual property

The site, including text, graphics, logos, photos, and design elements, is owned by or licensed to us and protected by IP laws. You may not copy, distribute, or create derivative works except as allowed by law or with our written permission.

8) Acceptable use

  • No misuse of the site (e.g., scraping, reverse engineering, interfering with security, or attempting to access non-public areas).
  • No use that harms or disrupts other users, our systems, or our suppliers.
  • No fraudulent orders or chargeback abuse.

9) Disclaimers

EXCEPT AS REQUIRED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow disclaimers of implied warranties, so parts of this section may not apply to you.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, OR DATA; OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM.

11) Dispute resolution & arbitration

  1. Informal resolution: Contact us at info@mylittlerascalspa.com and we’ll try to resolve within 30 days.
  2. Arbitration: If unresolved, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue: your county of residence or remote/online, at your option. Arbitrator may award individual relief.
  3. Small-claims option: Either party may bring an individual claim in small-claims court instead of arbitration.
  4. No class actions: You and we waive the right to participate in class or representative actions.
  5. Governing law: Pennsylvania law applies, without regard to conflicts of law, except that the Federal Arbitration Act governs arbitration.

12) Changes to the site or terms

We may update these Terms at any time. The “Last updated” date reflects the most recent changes. Continued use of the site after changes means you accept the revised Terms.

13) Severability & entire agreement

If any provision is found unenforceable, the remaining provisions remain in full force. These Terms (plus any policies referenced on the site) are the entire agreement between you and us regarding the site and products.
